Recently, the regulations of Shandong Province on the control of overload of goods transport vehicles (Draft) (hereinafter referred to as the "draft regulations") has been initially considered at the 36th meeting of the Standing Committee of the 13th National People's Congress of Shandong Province, and public comments will be solicited from now on. The deadline is August 30, 2022.

It is reported that the "bill" has six chapters and 43 articles, which mainly stipulate the source control, traffic control, safeguard measures and legal liability of overloaded cargo transport vehicles.

On the one hand, the bill adheres to the forward movement of the customs gate and the whole chain supervision, and stipulates the management measures of relevant departments from various links involving the source of vehicles, such as vehicle production, sales, registration, annual review, modification, maintenance, testing, scrap recycling and so on. On the other hand, by clarifying and implementing the responsibilities of territorial management and department supervision, we will promote the formation of a joint force to control the overload of cargo transport vehicles from the source of cargo loading and stowage.

In addition, in terms of legal liability, the bill stipulates that if a cargo transport vehicle illegally exceeds the limit for more than three times within a year, the transportation department of the people's government at or above the county level shall revoke its vehicle operation license and will not reissue it within a year. If the driver of a goods transport vehicle illegally exceeds the limit for more than three times within a year, the competent department of transportation of the people's government at or above the county level shall order him to stop engaging in commercial transportation. If a road transport enterprise illegally transports more than 10% of its total cargo transport vehicles within one year, the competent department of transportation of the people's government at or above the county level shall order it to suspend business for rectification; If the circumstances are serious, its road transport business license shall be revoked and announced to the public.
